A LETTER TO THE L&DCC FROM AIGBURTH CRICKET CLUB

We were delighted to receive the following letter and, as requested, share it with all:

"Guys

As you are all aware (http://www.lpoolcomp.co.uk/news.php?id=2149we, Aigburth Cricket Club, were in court on 17th & 18th August in an effort to get a new lease.

The judge overseeing it all had called for a preliminary trial (the one on 17th & 18th) before deciding which way it would go. The aim of the preliminary trial was to decide;

a) Whether the current trustees had the legal power to apply for a new lease

b) Whether the landlord had shown INTENT to demolish the premises (as detailed in the eviction notice) 

After a roller coaster ride over the 2 days listening to witnesses, solicitors, barristers, finally the Judge decided that

a) One of the current trustees did have the legal power to apply for renewal

b) The landlord had NOT shown INTENT to demolish

He also decreed that

i) The defendant (PR Investments - the landlord) should pay our costs.

ii) The defendant may appeal to the Court of Appeal on point a).

iii) The defendant did not have the right to appeal on point b).

iv) His decision was final

Our legal team (who were brilliant) are pleased with the outcome. However because the land is worth a huge sum of money to the landlord they advised caution on how we proceed.

The immediate outcome is that we will remain on the property for a little while yet. This is not the end but the beginning of a long road, but we start that journey with renewed confidence.

Once we get more certainties of where we are going I'll keep you posted
